Associate - Social Justice Lawyer - Research and Appeals
ASAP Law Barristers is looking for an Associate Lawyer - Research and Appeals, to help this social justice practice. If you went into law to help people, this may be the opportunity for you. This is not corporate law; you will be assisting people experiencing mental health crises and who require emergent legal representation.
The Position
This is a dynamic role where you will utilize your exceptional research skills to prepare case briefs for your principal lawyer. There is only a seven-day window from date of application to date of Hearing when working on matters before the Consent and Capacity Board. You must be comfortable in a fast-paced role, and your primary responsibilities will be to prepare briefs within a three-day window, assist with appeals and conduct Hearings. Can you work independently? Do people call you empathetic? Are you a Barrister or a Solicitor?
You will work closely with seasoned lawyers who will mentor you and your practice.
We conduct Hearings before the Consent and Capacity Board and the Ontario Review Board. You will be working with individuals facing significant mental challenges and you may be required to attend hospitals, courts, and prisons across Ontario. You must be able to quickly build rapport with individuals in active crisis.
Currently, all CCB hearings are being held either on video or teleconference, ORB hearings are in person.
You’ll succeed here if you are:
Exceptional Researcher– you will primarily be dealing with health law and criminal law; specifically s.672 litigation. You must be quick and accurate in your research and be able to write comprehensive briefs
Excellent Communicator – you bring with you the ability to quickly build rapport with clients and colleagues and you do not shy away from in-person or on-line court work
Independent – you’re self-motivated and you manage and organize your time well
Flexible – able to shift focus and priority quickly to meet demands
Have Some Litigation Experience – You have appeared and argued cases before either a court or a tribunal in addition to assisting with file preparation for litigation as part of your articles or practice
Currently A Lawyer Member of the Law Society of Ontario – and therefore able to practice law as a lawyer in Ontario immediately.
Your Tasks will Include:
· Researching and drafting legal briefs and appeals in tight timelines
· Conduct Hearings before administrative Boards of competent jurisdiction. You will be trained how to do this.
· Effectively communicate with and cross examine expert witnesses, or a willingness to learn same
· Building rapport with clients in precarious situations to ensure their legal rights are protected
What makes you the Ideal Candidate?
· Membership in good standing with the Law Society of Ontario
· Demonstrated ability to balance multiple priorities, be self-motivated and problem solve effectively and diplomatically
· In-person court experience an asset
· Must be able to manage caseload independently
· Must have Legal Aid Ontario Solicitor number or be able to obtain one quickly
· Willingness to travel broadly in Ontario if that becomes necessary
· Possess a valid driver’s license
